Terms of Service

BusyKitchen installs and operates a done-for-you marketing system for your restaurant: managed advertising and social content that capture guest contact information, offers presented to that guest list, and follow-up communication by SMS, email, and social media messaging. Our plans are:

• Visible — $497/month: managed ads and social content built to capture guests; guest capture of name, phone, and email; offers written for your restaurant (first-visit, slow-night, birthday, and win-back); and SMS, email, and social messaging follow-up configured and ready to send. Under this plan you conduct the communication with your guests.
• Visible Plus — $697/month: everything in Visible, plus BusyKitchen conducting guest communication on your behalf across SMS, email, and Instagram and Facebook messages and comments. You review and approve offers and responses before they are sent, and receive a one-page monthly recap.

Advertising budget is not included in either plan. You pay advertising costs directly to the advertising platform (such as Meta or Google); BusyKitchen does not mark up or take a percentage of your ad spend.

Guest contact data collected by the system belongs to you. You may export it at any time and you retain it in full if you cancel. You are responsible for ensuring that offers and messages sent under your restaurant's name comply with applicable marketing and messaging laws, including obtaining valid consent from guests before they are contacted.

• Plans are billed monthly. There are no setup fees and no long-term contracts.
• Your subscription is month-to-month and renews automatically until you cancel.
• You may cancel at any time; cancellation stops future billing. We don’t charge cancellation fees.
• For managed advertising engagements, ad spend is billed separately through your own advertising account and is not part of our fee.

• Provide accurate information about your restaurant, specials, and events.
• Review and approve (or request changes to) offers, creative, and guest responses in a reasonable timeframe.
• Grant any account access needed to deliver the parts of the service you’ve signed up for.
• Ensure that anything you ask us to publish is truthful and that you have the rights to it.

The guest list built through the service — every name, phone number, and email it captures — is yours to keep, including after cancellation, and you may export it at any time. Content we create for you is yours to use for your restaurant. We may showcase work we’ve produced as examples of our services unless you ask us not to.

Our service relies on third-party platforms such as Facebook and Instagram. We don’t control those platforms and aren’t responsible for their availability, policies, or decisions. See our Facebook Disclaimer.

We provide marketing work, not guaranteed business outcomes. We make no promise of revenue, guests, or any other result. Please read our Earnings Disclaimer, which is incorporated into these Terms.

To the fullest extent permitted by law, BusyKitchen is not liable for any indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

Your use of our services is also governed by our Privacy Policy.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Continued use of our website or services after a change means you accept the updated Terms.
